E-mailberichten?

Some of President Barack Obama's political appointees are using secret government email accounts to conduct official business, The Associated Press found, a practice that complicates agencies' legal responsibilities to find and turn over emails under public records requests and congressional inquiries.
White House spokesman Jay Carney on Tuesday acknowledged the practice and said it made eminent sense for Cabinet secretaries and other high-profile officials to have what he called alternative email accounts that wouldn't fill with unwanted messages. Carney said all their email accounts, public and otherwise, were subject to congressional oversight and requests by citizens under the U.S. Freedom of Information Act.
Say what?
The practice is separate from officials who use personal, nongovernment email accounts for work, which generally is discouraged due to laws requiring that most federal records be preserved.
Having separate accounts could put an agency in a difficult spot when it is compelled to search for and release emails as part of congressional or internal investigations, civil lawsuits and public records requests. That's because employees assigned to compile such responses would necessarily need to know about the accounts to search them. Secret accounts also drive perceptions that government officials try to hide actions or decisions.
"What happens when that person doesn't work there anymore? He leaves and someone makes a request (to review emails) in two years," said Kel McClanahan, executive director of National Security Counselors, an open government group. "Who's going to know to search the other accounts? You would hope that agencies doing this would keep a list of aliases in a desk drawer, but you know that isn't happening."
It said it needed to pull 2,236 computer backup tapes from its archives and pay 50 people to pore over old records. Those costs included three weeks to identify tapes and ship them to a vendor, and pay each person $2,500 for nearly a month's work. But under the department's own FOIA rules — which it cited in its letter to the AP — it is prohibited from charging news organizations any costs except for photocopies after the first 100 pages. The department said it would take 14 weeks to find the emails if the AP had paid the money.

Mr. Fairey said that he had initially believed that The A.P. was wrong about which photo he had used, but later realized that the agency was right.
In settling the civil lawsuit, “The A.P. and Mr. Fairey have agreed that neither side surrenders its view of the law,” The A.P. said in a statement on Wednesday. “Mr. Fairey has agreed that he will not use another A.P. photo in his work without obtaining a license from The A.P. The two sides have also agreed to work together going forward with the ‘Hope’ image and share the rights to make the posters and merchandise bearing the ‘Hope’ image and to collaborate on a series of images that Fairey will create based on A.P. photographs.” The statement added that the two sides had agreed to “financial terms that will remain confidential.”
From in or about mid-March through in or about late March 2009 [...] SHEPARD FAIREY, the defendant, created multiple false and fraudulent documents (the "Fake Documents") that were intended by Fairey to demonstrate [...] that FAIREY had used the Clooney Photograph as a reference in creating the Obama Progress Work and the Obama Hope Work. For example, Fairey created images that made it appear that he had worked with the Clooney Photograph in creating the Obama Progress Work and the Obama Hope Work. In truth and in fact, and as FAIRLEY then and there well knew and believed, FAIRLEY had used the Obama Photograph as a reference in creating the Obama Progress Work and the Obama Hope Work and had not used the Clooney Photograph.
For the AP case we need to either find an old email or document that talks about the company policiy to back up or throw away files we are not using. If we can't find anything like that we need te create it and put it on our old letterhead.
Basically the AP is trying to say that I was trying to hide the source of the Obama image by throwing away the in-progress elements. The simple truth is that I threw that stuff away because I did not want to waste hard drive space and I never thought I'd need it again. I know at some point in time we either emailed of printed a memo on saving drive space. [P]lease see if you van find it. Thanks - Shepard
In or about early October 2009, an employee of Obey Giant [het bedrijf van Fairley, IKo] searched again for the files identified by the AP and, in so doing, discovered the Deleted Documents on an Obey Giant server.

  1. Any documents, memos, reports, or other records that would show how many people have been arrested and how many convicted each year for the past ten years under federal anti-terrorism laws.
  2. Any documents, memos, reports, or other records that would show how many people have been detained without arrest each year for the past ten years for ties to terrorism.
  3. Any documents, memos, reports, or other records that would show the current status of people convicted and the sections and subsections of crime under which they have been convicted under antiterrorism laws during the past 10 years.
  4. Any documents, memos, reports, or other records that would show the nationality of those arrested and convicted under anti-terrorism during the past 10 years.
  5. Any documents, memos, reports, or other records that would show the names, dates and circumstances for people arrested under federal anti-terrorism laws for the past ten years.
  6. Any audits, surveys or studies of federal anti-terrorism published in the last 10 years.
Dutch officials provided a partially responsive not useful promise to provide answers to one part of AP’s request.
  • Only 14 countries answered in full within their legal deadline. Another 38 countries eventually answered most questions, at least providing data.
  • Newer democracies were in general more responsive than some developed ones. Guatemala confirmed the AP request in 72 hours, and sent all documents in 10 days. Turkey sent spreadsheets and data within seven days. Mexico posted responses on the Web. By comparison, Canada asked for a 200-day extension. The FBI in the United States responded six months late with a single sheet with four dates, two words and a large section blanked. Austria never responded at all.
  • More than half the countries did not release anything, and three out of 10 did not even acknowledge the request. African governments led the world for ignoring requests, with no response whatsoever from 11 out of 15 countries.
